Buying Property - Legal Checklist

I've been asked for this a few times, so thought it best to leave it here.

NOTE: This is for use in England UK buying residential property, but can also be handy elsewhere


PRE PURCHASE AGREED
Give details to solicitor and ask them to issue forms

ON AGREEING PURCHASE
Return signed forms to Solicitor
Provide ID and cheque for search fees to solicitor
Provide Money Laundering (i.e. bank statements) if available to solicitor


WEEK ONE
Request Contract Package
Request copy HIP
Apply for Local Authority Search & Water Search if no HIP Apply for Chancel & Environmental Search



WEEK TWO / THREE
Checks ownership of the property [to ensure has the right to sell] Check contract packages [when received]
Raise additional enquires
Put in hand any additional searches that maybe relevant

Ask seller's solicitor to raise enquiries with Management Co [if leasehold] Report to client when received a contract pack
Sends copy of Property questionnaire, Fixtures and fittings list to client When received local search report to client [usually takes 2 weeks]

Send Contract & Transfer to client for signature

WEEK FOUR
Upon receipt of mortgage instructions report to client
Send Mortgage Deed to client to sign
Ensure that clear search results have been obtained
Ensure all additional enquires have been answered
Send draft completion statement to client and request deposit monies Ensure buildings insurance in place


WEEK FIVE
Agree a completion date
Send deposit to solicitor (making sure bank statement provided) Exchange


WEEK SIX
Complete
